What is an employee?

An employee is the party involved in a work contract who performs a worked in exchange for salary compensation. In this it differs from the other party involved in the contract: the employer, who is the one who provides both the job and the economic remuneration. In other words, an employee is someone who regularly performs a paid task (that is, who has a job).

Characteristics of an employee

The general characteristics of an employee are the following:

  • You can dedicate yourself to tasks of a productive, administrative or logistical nature, with a greater or lesser degree of autonomy and specialization. The higher the latter, the higher the salary compensation received.
  • He can be fired from his position, which means that the employer terminates the employment relationship. In turn, the employee can resign from the job, ending the employment relationship by their own hand.
  • You can be employed in both private (for-profit companies) and public organizations or NGO (non profit).
  • They can be public employees or private employees, depending on whether their employer is the State, or a private organization.

Difference Between Employee and Worker

Self-employed workers are not employees as they do not have a fixed employer.

All employees are, in one way or another, workers: they perform a job and are paid financially in exchange for their time and effort. However, not all workers are necessarily employees: some of them perform piecework, that is, autonomously or freelancing.

These workers do not have an employer, but are hired for casual work by the highest bidder, or they develop entirely their own economic activity, that is, they are their own bosses. In this case, we can not call them employees, but self-employed.

Public employee and private employee

Employees can be classified into:

  • Public employees: They are those who carry out their work in a public organization (belonging to the State).
  • Private employees: They are those who work in a private organization (belonging to third parties).

In general, both cases are governed by what is established in their contracts and in the Labor lawswithout much distinction between one and the other. However, being non-profit, the public work structure can in some cases be much more generous than the private one with the employee.

This means that public employees (generally considered officials) enjoy certain privileges, but in return they are also subject to rules more strict, to a greater ethical vigilance (against corruption) and to the cuts and modifications that the new State structure may make. governments from the country.

Other than that, there is no major difference between public employees and private employees: the former are government employees, the latter are third-party employees.
